Understanding the Risk Categories

The AI Act classifies AI systems into four risk tiers, and your compliance obligations depend entirely on which category your systems fall into.

Unacceptable risk systems are banned outright. These include social scoring systems, real-time biometric surveillance in public spaces with limited exceptions, and AI that manipulates human behaviour in harmful ways. If your business uses any of these, you must discontinue them immediately.

High-risk systems face the strictest requirements. These include AI used in recruitment, credit scoring, law enforcement, critical infrastructure management, and education. Companies deploying high-risk AI must implement comprehensive risk management, maintain detailed technical documentation, ensure human oversight, and register their systems in the EU's public database.

Limited-risk systems, such as chatbots and content recommendation engines, must meet transparency obligations. Users must be clearly informed when they are interacting with AI, and AI-generated content must be labelled as such.

Minimal-risk systems, covering the vast majority of AI applications, face no additional regulatory requirements beyond existing law.

Key Compliance Steps

For businesses that determine they are using high-risk AI systems, several concrete steps are required. First, conduct a thorough inventory of all AI systems in use across your organisation. Many companies discover they are using AI in ways they had not formally catalogued, from automated HR screening tools to predictive maintenance algorithms.

Second, perform a conformity assessment for each high-risk system. This involves documenting the system's purpose, the data it was trained on, its accuracy metrics, and the safeguards in place to prevent discriminatory outcomes. Third-party audits may be required for certain categories of high-risk systems.

Third, establish a quality management system that covers the entire lifecycle of your AI systems, from development through deployment to retirement. This includes processes for monitoring performance, handling complaints, and implementing corrections when issues arise.

Data Governance Requirements

The AI Act introduces specific data governance requirements that go beyond existing GDPR obligations. Training data for high-risk systems must be relevant, representative, and free from errors to the extent possible. Companies must document their data collection and preparation processes and be able to demonstrate that their datasets do not encode harmful biases.

For companies using third-party AI models or APIs, the responsibility chain is clear: deployers are responsible for ensuring that the systems they use comply with the Act, even if they did not develop the underlying technology. This means businesses using tools from OpenAI, Google, or other providers must verify compliance rather than assuming it.

Penalties and Enforcement

The penalties for non-compliance are substantial. Violations related to banned AI practices can result in fines of up to 35 million euros or 7 percent of global annual turnover, whichever is higher. High-risk system violations carry fines of up to 15 million euros or 3 percent of turnover.

National authorities in each member state are responsible for enforcement. Portugal's national supervisory authority has been established under the CNPD, which also oversees GDPR compliance. The authority has signalled a pragmatic approach during the initial enforcement period, focusing on guidance and education before moving to penalties.

Resources for SMEs

The European Commission has recognised that smaller businesses may struggle with compliance costs. Several support programmes are available, including free conformity assessment tools, subsidised training programmes, and regulatory sandboxes where companies can test AI systems under supervisory guidance.

In Portugal, IAPMEI and the national AI competence centre offer specific support for SMEs navigating AI Act compliance, including workshops, templates, and one-on-one advisory sessions.

Moving Forward

The AI Act is not just a regulatory burden. Companies that achieve compliance early will have a competitive advantage, as public and private sector organisations increasingly require AI Act compliance from their suppliers.
